Art360 Scotland Application Terms & Conditions

These Terms and Conditions apply to applications for participation in the Art360 Scotland Programme (Programme). By submitting an application to participate in the Programme, applicants confirm acceptance of these Term and Conditions and agree to comply with them.

Art360 Foundation will accept applications between 12 April 2019 (Opening Date) and midnight on 31 May 2019 (Closing Date). Any applications received by Art360 Foundation after the Closing Date will not be considered.

Applicants should apply online through the Art360 Foundation website at www.art360foundation.org.uk. Alternatively, requests for a paper version of the application form should be made to contact@art360foundation.org.uk. If you are experiencing problems with the online application form, please contact contact@art360foundation.org.uk.

Applicants must be at least twenty-one (21) years of age and must be an artist (or the estate of an artist) who has lived and worked in Scotland during a significant part of your/their career. Applications can be made by artists and estates working in all media.

Each applicant shall only submit one entry per year.

Successful applicants will be selected by a panel of artists and Art360 Foundation representatives from all applications received in accordance with these Terms and Conditions. Art360 Foundation reserves the right to make further enquiries relating to applications and applicants’ eligibility to participate in the Programme.

The panel's decision is final, no correspondence will be entered into and the panel’s deliberations will remain confidential. For the avoidance of doubt, Art360 Foundation will not disclose any information relating to the decision-making process including the criteria used to arrive at its decision. Requests for such information will not be processed.

Art360 Foundation will notify successful applicants by email or telephone (using the details provided in the application) in July 2019. Successful applicants shall confirm their willingness to participate in the Programme within three (3) working days of such notification.

If the selection panel cannot contact the successful applicant (via the details provided in the application) within ten (10) working days after the panel has made its selection or if the applicant does not confirm his/her willingness to participate in the Programme within three (3) working days of receiving notification from the selection panel, that applicant may be disqualified. The selection panel reserves the right to select another applicant to take the place of the disqualified applicant.

Art360 Foundation does not guarantee that its website or any online application form will always be available or uninterrupted. Art360 Foundation will not be liable to any applicant if for any reason the website or online application form is unavailable at any time or for any technical problem or malfunction that prevents the submission of an application.

Applicants agree to their name being published on the Art360 Foundation website and via Art360 Foundation’s social media accounts.

Applicants warrant that the information provided in their application is true to the best of their knowledge. Art360 Foundation, in its sole discretion, reserves the right to disqualify any applicants if any information supplied is inaccurate or misleading or for any breach of these Terms and Conditions.

Information provided by applicants will not be shared with third parties except for Art360 Foundation’s current or future partners (including but not limited to Creative Scotland, DACS, P F Charitable Trust, National Galleries Scotland and the Henry Moore Foundation). The completion of an application does not guarantee participation in the Programme. Successful applicants will be asked to sign a Participant Agreement with Art360 Foundation. Participation in the Programme is subject to entering into a Participant Agreement and acceptance of any other terms and conditions Art360 Foundation may impose in its discretion.

Applicants may withdraw their application at any time prior to signing a Participant Agreement by notifying Art360 Foundation in writing. Art360 Foundation will consider all such withdrawals as final.

Should Art360 Foundation disclose any sensitive or confidential information to the applicant, the latter shall treat this information as confidential and shall not further disclose this information to any third parties.

Art360 Foundation may change or vary these terms and conditions at any time without any prior notice.  It is the responsibility of applicants to ensure that they review these Terms and Conditions regularly on the application page.

Further information on the Programme can be found in the prospectus available on the Art360 Foundation website. In the event of any conflict between any information within the prospectus and these Terms and Conditions, these Terms and Conditions shall prevail.

These Terms and Conditions shall be governed by English law, the parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales.
